It is easy to represent yourself at the magistrate (small claims) level. There,
you can file your complaint on a hand written form and you can respond to a
complaint just as easily. Overall, the small claims court forum exists to resolve
disputes in the absence of counsel. That said, on appeal, everything changes.
Complexities on Appeal.
If either party takes an appeal from the magistrate (small claims) court, certain
formalities come into play, which means you take great risks by representing
yourself. For example, you risk blowing a deadline to respond to the appeal,
file a complaint, answer, or respond to discovery. Likewise, the formalities
required of your complaint, answer, and pre-trial submissions increase
dramatically on appeal.
Trial Litigation.
